What is a trademark?

Trademarks may consist of any signs like words, including personal names, figures, colors, letters, numbers, sounds and the shape of goods or their packaging, provided that such signs are capable of distinguishing the goods or services of one undertaking from those of other undertakings and being represented on the register in a manner to determine the clear and precise subject matter of the protection afforded to its proprietor.

Who may apply for trademark protection in Turkey?

The protection for trademarks in Turkey is available to natural or legal entities domiciled or engaged in industrial or commercial activities within the borders of Republic of Türkiye, or to the persons who have the right of application according to the Paris Convention or Agreement Establishing the World Trade Organization. Natural or legal persons other than those referred above, who are citizens of states which accord legal and de facto protection to the citizens of the Turkish Republic shall enjoy trademark protection in Turkey according to the reciprocity principle.

Trademark Proceedings in Turkey: How/What is Required/Time Frames?

To begin with, the only required document to file a trademark application in Turkey, is a simply signed Power of Attorney. A list of goods and/or services and a logo sample- (this is only required if the trademark consists of a device) must also accompany the POA to be sent.
Below is a brief description of trademark proceedings after filing in Turkey:

1)The trademark is published, in the absence of any provisional refusal, 1 – 3 months after the filing. If there is any office action, it is also issued 1 – 3 months after the filing.

2) If an opposition by a third party is filed, you have 1 month to file a response. If a provisional refusal issued to the application, you have 2 moths to file a response.

3) The trademark remains on publication for 2 months. If no opposition by a third party is filed, registration decision is issued after 1 – 2 months after the end of the publication period.

4)The registration fees must be paid within 2 months after the registration decision is issued.
